The Formation of the Agreement Between You and Us
- To initiate a purchase of a product listed for sale on the website, simply select the product of your choice and follow the onscreen instructions. You will be able to review and correct any error in your order until you confirm the purchase by pressing the "Proceed to Secure Payment" button found on the "Payment Details" section. Please note that once you have confirmed your order, you will not be able to make any changes to it.
- Upon receipt of your order, our system will automatically issue an acknowledgment email, providing you with an order reference number and a detailed summary of your order. However, this communication should not be misconstrued as an acceptance of your order. Essentially, your order represents a proposal to acquire a product. Our acceptance of your order is conditional upon our formal approval, which we will confirm through an email notifying you of the product's dispatch (referred to as the Dispatch Confirmation). It is only upon issuing the Dispatch Confirmation for the respective product that a formal sales contract is established between us. For orders involving multiple products with different delivery times, a distinct contract for each item will be constituted upon the issuance of the corresponding Dispatch Confirmation for each product.
- Each contract we form with you is specifically for the products we've confirmed as dispatched in the Dispatch Confirmation. We are not required to deliver any other products that might have been included in your order until we issue a separate Dispatch Confirmation for those items.
- We may choose not to accept your order for any reason, and in such cases, we will not bear any liability to you or any third party.
- We may not be able to process your order if:
- a. The product you want is either out of stock or no longer available.
- b. There's an issue with the authorization of your chosen payment method.
- Some products offered on the website are governed by legal age restrictions. Legally, we cannot provide these products to individuals who do not meet the specified age criteria. Therefore, if you are below the required age, you should not attempt to order these products. When you register on the site, use its services, or make a purchase, you affirm and assure that the information you supply, particularly your date of birth, is complete, accurate, and current.
2.1 We will ship the product(s) to you according to the delivery method you chose when placing your order.
2.2 We will dispatch all the products in your order simultaneously, although sometimes they may arrive in separate packages. The delivery will be made to the address you specified in your order. Please note that we cannot send items from the same order to different addresses. Also, we do not take responsibility for any extra handling or placement of the products you have ordered.
2.3 For items that are particularly bulky or heavy, a delivery fee may apply. This charge will be included during the checkout process. It's important to review and be comfortable with the delivery charge before finalizing your order at checkout.
3. Risk and Ownership
3.1 After the products you ordered are delivered, they become your responsibility. Except for cases where the products are damaged, faulty upon delivery, or delivered incorrectly, we will not be liable for any loss, damage, or destruction of the products once they have been delivered.
3.2 You will become the owner of the products either when they are delivered to you or when we receive the full payment for them, whichever happens later.
4. Price and Payment
4.1 The cost of products is as stated on the website, unless there's a clear and obvious error.
4.2 The listed prices do not include the costs of delivery. Once you select a delivery option from those available, the delivery charges will be added to your total amount.
4.3 Prices are subject to change at any time. However, any price change will not affect orders for which you have already received a Dispatch Confirmation from us.
4.4 Your order cannot be finalized until full payment is received. You can pay using major credit or debit cards by filling out the necessary information on the Payment Details page.
4.6 Despite our best efforts, there is always a possibility that some products on the website might be wrongly priced at times. We will promptly correct any errors as soon as they come to our attention. In the event that the actual price of a product differs from the price shown on the website, we typically, at our own discretion, will either reach out to you for further instructions before shipping the product or choose to decline your order and inform you about this rejection.
5 Cancellation, Returns and Exchange Policy
5.1 If any product you purchase is damaged, faulty, or not as described, you can return it for an exchange or store credit as appropriate within 30 days of delivery of the product. Exceptions include products that are (i) customised or personalised for you (ii) already used by you (iii)
5.2 If you choose to cancel an order after the products have been dispatched, it becomes your responsibility to send them back to us. We will not be accountable for any loss or damage to the products during their return transit. Make sure to return these products within the timeframe outlined in the Returns Procedure. Until they are returned, it's important that you keep the products with you and take appropriate care of them.
5.3 You should return the products to us in the same condition in which you received them, together with the original product packaging, in accordance with our Returns Procedure.
5.4 You will be responsible for covering the shipping costs. Hairporium does not provide refunds for any shipping fees, whether from the original delivery, the return, or subsequent shipping expenses.
6 Our liability
6.1 We have a legal obligation to provide products that comply with the terms of the contract. We are not liable for any loss that could not be reasonably anticipated, nor for any business-related loss, which includes lost profits, contracts, goodwill, opportunities, and other similar losses.
6.2 We are not liable for any failure or delay in fulfilling our obligations if it's due to events beyond our reasonable control.
7.1 We reserve the right to modify and update these Terms & Conditions periodically without prior notification by changing them. However, it's important to note that any changes made will not impact any purchases you have completed prior to the implementation of these changes.
7.2 Our decision not to enforce a particular right should not be interpreted as a relinquishment of that right. Additionally, you are not permitted to assign or transfer your rights under these Terms & Conditions.
